A new law enacted at the end of the 2023 legislative session legalizes adult–use cannabis in Minnesota and establishes a regulatory framework over the cannabis industry. The law establishes the State of Minnesota’s Office of Cannabis Management (OCM) as the licensing authority for adult-use cannabis businesses. Cannabis Ordinance
Municipalities are required to allow operation of cannabis businesses licensed by the state. The Office of Cannabis Management will work with the city to verify zoning compliance as part of the application process with the state.
The City of Plymouth adopted Ordinance 2024-24 regulating cannabis and hemp businesses, effective as of November 26, 2024. These regulations include updates to zoning regulations, allowing cannabis businesses in certain commercial and industrial districts subject to certain buffer requirements and operational standards. Note that retail businesses may not be located within 500 feet of schools, park areas, playgrounds, or residential treatment facilities. Cannabis Retail Registration
Once a state license is issued for a cannabis or hemp retailer or business with retail endorsement, the city will regulate these businesses locally by issuing a local Cannabis Retail Registration. The city has limited the number of Cannabis Retail Registrations available to one for every 12,500 residents, a maximum of seven in Plymouth. Retail Registrations will be issued on a first-come, first-served basis until the maximum is reached.
No cannabis retailer, medical combination business, microbusiness or mezzobusiness with retail endorsement may make retail sales to customers or patients until obtaining a valid OCM license and local Retail Registration. Lower-potency hemp edible retailers will be required to obtain a Retail Registration once the OCM starts issuing hemp business licenses in Fall 2025, but they will not be subject to the per capita limit.
Cannabis Tax
As of July 1, 2023, all sellers of taxable cannabis products must register with the Minnesota Department of Revenue to remit the new Cannabis Tax. More information is available on the Minnesota Department of Revenue's website.
